A Far North iwi is vowing not to give up its battle against a developer planning holiday homes on what it says are ancient burial caves, despite a court setback this week.

The dispute centres on Karikari Beach, a seven-kilometre sweep of sand on the northern side of the Karikari Peninsula which - like New Chums Beach in the Coromandel - is as yet undeveloped.

Carrington Farms, which is owned by United States millionaire Paul Kelly, wants to subdivide a piece of beachfront land into 12 lots. But Ngati Kahu elders say some of the house sites are on a rise riddled with burial caves of the children of their ancestor Kahukura.
